Foxwoods zoning suit (88 EM 2007)

In this suit filed on June 1, 2007, Foxwoods asks the Supreme Court to order the City to issue a zoning permit so that it can build its casino. Foxwoods argues that the R10A legislation sponsored by Councilman DiCicco and passed by City Council is spot zoning and unconstitutionally deprives Foxwoods of the use of its property.

It looks like the Court is in a hurry to rule on Foxwoods' suit. The deadline for the City to submit its brief is June 13, 2007. The City Solicitor asked for 30 additional days to brief the case, but got just two.

The form of Foxwoods' suit--an emergency petition for review--is the same as that used by the Gaming Board to block the casino referendum. If the Court rules as quickly as it did in the referendum case--i.e., the same day as receiving briefs in opposition--it could rule on Foxwoods' zoning suit as early as Wednesday, June 13, 2007.
