Please repeal House Bill 1954. I live in the Old City section
of Philly and I see the need for this right every day. We are
inundated with bars and problems in this neighborhood because
the city and state governments took it upon themselves to give
100 liquor licenses out in our neighborhood to form
an "entertainment district". Now it's up to the residents to
control the gangs of drunks and the occasional murder that
happens in our neighborhood that was a quiet artists community
before they did what they wanted with the area. As a member of
the Old City Civic Association, we deserve the right to have
our say in our own neighborhood. We are the ones who live here,
they do not.

As a member of the executive committee of the Old City Civic
Association, an active voter and a long-time resident of
Philadelphia, I write to ask that you support HB 1698 introduced
by Rep. Mark Cohen and make every effort to overturn the limits
placed on citizens' rights by Act 193 to challenge decisions of
the Zoning Board of Adjustment. Citizen standing is too
important an issue to be legislated away in the middle of the
night, without public notice and with legislative revisions
sponsored by the Outdoor Advertisers Association of
Pennsylvania. Please protect the rights of our neighborhood
organizations to challenge decisions of the ZBA. Thank you,

As a long time representative of our district, I am sure you
understand the importance of a system of checks and balances.
With regard to the Philadelphia Zoning Board of Adjustments and
the right of a Community organization to appeal their rulings,
this system is key. In Philadelphia, the Board is made up of
political appointees who have little to no knowledge of
historic preservation, city planning, etc. Please support the
repeal of House Bill 1954.

I write to you as a former member of the Philadelphia Zoning
Board of Adjustment; I served for 13 years; I was vice chairman
for 9 of those years. However, I feel strongly that House Bill
1954 should be repealed for many reasons. Since the board is a
quasi judicial body, there must be an appeal process to review
possible errors of law in decisions made by the zba. Secondly,
the board has alot of power, and there needs to be a review
should that power be inadvertently misused. Finally, there are
pressures beyond the control of the board which sometimes come
into play at a hearing, and the resulting decisions need to go
thru a review by a higher court. If the board has handed down a
fair and correct decision, then the common please court will
affirm that decision; if not a miscarriage of justice might
result.

Honorable State Representative Josephs:
Please vote to repeal Pennsylvania House Bill 1954. The removal
of appeal rights of private citizens in Philadelphia for
decisions made by the appointed Zoning Board of Adjustment
places development decisions by this group in the category of
taxation without representation. The rider providing for this
condition was slid in without proper discussion or framing of
the issues for the legislature and for that reason alone it
seems spurious.
