raped and had his face slashed with a box cutter. Two witnesses
identified the defendant crawling out of the bushes from which
the naked victim had emerged. He was apprehended by police with
the box cutter and a bloody rag. Massiah-Jackson ruled that the
police lacked probable cause to arrest the man and suppressed
the box cutter, the rag and other evidence as fruits of an
illegal arrest.

In one case, the judge did bring herself to impose a harsh
sentence, explaining that among other aggravating factors, the
defendant was a "Caucasian."

In the Easterling case, the defendant pled guilty to burglary
and criminal conspiracy. Despite nine prior adult property
convictions and two burglary convictions, Easterling was
sentenced to only 11 to 23 months in prison (three years less
than the standard guidelines).

In the Williams case, the defendant pled guilty to robbery and
possession of an instrument of a crime. He had snatched a
woman's purse and deeply slashed her with a razor blade.
Williams too had a prior criminal record, yet Massiah-Jackson
sentenced him to only 11 to 23 months and instantly paroled him.

Massiah-Jackson has used all of her discretionary power to
reduce sentences for career criminals. She has excluded
evidence, downgraded charges, delayed trials and twisted the
clear meaning of statutes. In two cases, Massiah-Jackson refused
to rule that abdominal gunshot wounds (necessitating
colostomies) constituted "serious injury."

Between 1988 and 1989, the judge presided over 66 bench trials
of defendants accused of aggravated assault. In 14 cases, the
judge found the defendants not guilty of the most serious
charge. In 37 cases, she found the defendants not guilty of any
charge. She once counseled a defendant to "ask his friends in
jail" whether she would do right by him at a bench trial.

Subject:   Delinquent Child Support for Gabriel Graham

Mrs. Massiah-Jackson, my name is Kimberly Jackson. My son
Gabriel Graham will be ten years old on January 20th. And since
we were awarded child support in April of 2001,$290.66. I think
Miguel Graham, my son's father, has only paid in total a years
worth of child support. I have a case out of Arizona. But they
are unable to reach him by mail or by phone. Arizona does alot
of cooresponding with the Philadelphia Family Court with no
success. I believe Mr. Graham has gone underground so that he
can't be reached by conventional means. Miguel Graham is 15 or
16 thousand dollars behind in child support and he is making no
efforts to pay. He has had warrants out for his arrest and has
missed court dates there at the Philadelphia Family Court. My
case in Arizona is an active case but I am having a hard time
getting any information out ot them because they are having a
hard time getting anything accomplished with Philadelphia.
Please help me. I am in the process of medically retiring out
of the Army because of my cronic knee problems. I have been in
for eleven years now and was hoping to retire. I have had three
knee surgeries since June 8th 2004. Because I'm getting out of
the military my son's medical insurance and bills will have to
be paid by me. The money I would get for child support would be
a big help in paying for medical insurance as well as other
necessities. Miguel has moved around Philadelphia as well as
New Jersey trying to evade the courts. But, I am desperate. I
truely need that money. And I need it to come on a regular
basis. He has told me that he doesn't want to see our son. But
just because he doesn't want to see him doesn't excuse him from
paying child support does it. I am pleading for help from your
office. Like I said, I have a case out of Arizona. They need
help locating Mr. Graham also. I also have case numbers and
phone numbers to my case manager there in Arizona. I will give
them to anyone who needs them. I just need someone to contact

Hello Again!

I wrote to you some time ago about my brother who is at CFCF,
Melvin Laney,(674872) who I feel is getting a raw deal. First I
would like to thank you for responding to my letter so quickly,
although nothing came of it. After writing to you, his lawyer
was summoned to court to see if anything could be done, but
everything his lawyer asked for the judge denied. The only
thing they offered him,at that time, was a trial without a jury,
now I don't know how you feel about that, but what black man
(innocent or guilty) would go for that, we already see the
system doesn't work for us.

Well getting back to the reason I'm writing this letter. I was
just informed, by my brother, that they changed the DA and the
judge on his case. We're trying to find out when his trial
comes up in April will they postpone it again, since they are
new to the case. He is suppose to go to court April 12,2004
Rm.701.

Are they allowed to make a man sit for three years without a
trial. Look how quick the sniper was case handled because they
knew all of America would be watching, now is that fair justice
or what.

Dear Judge Frederica Massiah-Jackson,

I'm writing this letter to you to ask what happened to the
justice system for African-Americans.
My brother has been in jail at CFCF since 2001 for a murder he
swears he didn't commit. I'm not writing you to plead his
innocence, because I don't know if he is innocent or guilty, but
I know he has a right to prove it.
Everytime his case went in front of Judge James Lineberger it
was postponed and for the third time, it was postponed again,
this time a whole year, April 2004. My family does not have
alot of money, so he was appointed a lawyer Gregory Pagano whom
I believe would be a good lawyer if he could just be heard.

My brother was even loyal to the justice system. In 2002 he was
released in error. When his lawyer told him it was a mistake,
he could have ran, but instead he went right back. Does that
sound like a guilty man.

Judge Jackson, I really believe if this was a high
profilecase,my brother would have been heard by now. If there
is anyway you could get this Judge Lineberger or another judge
to hear this case heard earlier. It would be ashame if my
brother is innocent and he has to spend years in jail for
nothing.

As a native Philadelphian I have always regarded the park
system as defining a very special city. As a child, my family
would take Sunday strolls in Fairmount Park; as a Boy Scout, we
would take hikes along the Wissahickon; and where I would, later
as a parent, take my daughters for riding lessons; and where my
aging father would sit on a bench by the stream and adore his
beautiful grandchildren I live on a city block that ends at Morris
Park, where my daughters played when they were very young. And
now my grandchildren have the benefits of the parks.

In your selection of new members to the Fairmount Park
Commission, I urge you to strongly consider the Coalition Slate
of Candidates. Any one of the coalition, Ed Bronstein, Michael
DeBerardinis, Debra Wolf Goldstein, Joseph M. Manko, David P.
Pope, Doris A. Smith, or William A. Wilson, would be an excellent
choice for the existing vacancies.
As a member of the Wissahickon Restoration Volunteers, I have
seen first hand how the Wissahickon Park area has been allowed to
suffer from neglect and misuse. I have also seen the need for a
strong and visionary leadership to bring guidance and support for
the many grass roots organizations, such as the WRV, which are
trying to restore the Park to its former splendor.
Furthermore, it is equally vital to select a commission which
will find creative ways to manage the "confusing overlap of
mission between the Park Commission and the city's Recreation
Department" (Phil. Inquirer 5/14/02)

As a supporter of the coalition slate candidates (Ed Bronstein,
Michael DiBerardinis, Debra Wolf Goldstein, Joseph M. Manko,
David P. Pope, Doris A. Smith, William A. Wilson)which have
also been endorced by Friends of Philadelphia Parks as well as
twenty-one organizations and park groups, I strongly advocate
for Park Leadership that supports green spaces for the
Philadelphia community.

It is my opinion that the above named candidates represent a
broad constituency of people with varying backgrounds and
skills, any one of whom could serve the whole very well.

The parks in Philadelphia are very important to the quality of
city life. I live in Roxborouogh and have utilized the park
throughout my childhood and adult life. This asset is one of
the reasons I have remained a city resident-tax payer.
A strong vision is necessare to maintain the quality park
system that has been such a great part of my life. These
candidates can fufill that vision.
