Man who raped girl in her bed gets 10 years
Twice the required minimum was imposed in a case the judge
called “every parent’s worst nightmare.”

A 32-year-old North Philadelphia man was sentenced yesterday to
10 to 20 years in prison for raping a 9-year-old girl in her
Kensington bedroom two years ago.

Todd Aviles, a graduate of Olney High School, pleaded guilty in
April to charges of rape, involuntary deviate sexual
intercourse, unlawful contact with a minor, and burglary.

The victim, now 11, rose from her seat in the court gallery to
stand next to her mother and older sister as they were providing
an impact statement to Common Pleas Court Judge Harold Kane. A
younger sister, 10, was also in court. . . .

Aviles broke into the family’s home through a front window about
6:30 a.m. Aug. 28, 2004. He went into the victim’s bedroom and
told her he was a Department of Human Services social worker and
that he was going to “examine her,” authorities said.

Then he raped her.

Afterwards, Aviles turned his sights on the victim’s older
sister, then 12, who was also in the room. The older girl
resisted. The commotion woke the girls’ mother and her
boyfriend, who chased Aviles from the house, police have said.

This was “every parent’s nightmare,” so the judge gave the
rapist twice the minimum sentence.

In sentencing Aviles, the judge said: “I don’t know how you
protect people from people like him… . Nothing can be more
egregious than to break into a house and rape their daughter.”
Really? Well, I’m not a judge, but I know how you protect people
from monsters like him; you lock them up and throw away the key!

But Mr Aviles did plead guilty; perhaps the judge was somehow
bound by a plea bargain agreement.

Nope!

Prosecutor Joseph Khan asked the judge to give Aviles a term of
30 to 60 years. The mandatory minimum sentence was 5 to 10 years.
If the prosecution was asking for 30 to 60, there was no plea
agreement which bound Judge Kane. Mr Aviles is 32 years old; if
he behaves himself in prison, he’ll be back out on the streets
when he’s only 42 years old.

Aviles’ lawyer, William J. Brennan, considered the sentence
appropriate. “If this case went to trial and resulted in a
conviction, I’m confident this case would have resulted in a
sentence that’s much, much, much longer,” he said.
Yup, sure would have — and sure should have, even with a guilty
plea.

This judge needs to be fired, period. Because of his actions,
when he had other options, a dangerous child rapist could be out
on the streets again at age 42. And if Mr Aviles gets out early,
and rapes another young girl, Judge Kane ought to be standing
beside him when he goes to court for that, and share the same
prison cell with Mr Aviles.

The judge knew that Mr Aviles was a monster, and wondered aloud
how to protect the public from people like him. But possessed
with the power to actually do something, to lock up Mr Aviles
until he’s at least 62 years old, Judge Kane choked.

He needs to be gone, he needs to be fired, and it needs to
happen now.

Dear Judge Kane:

We entitle your position "judge," because we expect people
holding such positions to exercise good judgement. When you
said, concerning Mr Aviles, "I don’t know how you protect people
from people like him," you apparently spoke the truth, because
such a minimal sentence for the rape of a nine-year-old girl,
and the attempted rape of a twelve-year-old, shocks the
conscience more than the crimes themselves. In this messed up
world, we expect to read about such horrors occasionally, and if
they are repugnant, they are nevertheless no longer surprising.

But to read that a respected judge, despite the pleas of the
District Attorney to put this monster away until he is elderly,
handed down a sentence which could set this man free and back on
the streets at age 42, is surprising, and shocking. That is not
the exercise of good judgement; it is a case of extremely poor
judgement.

Having handed down this sentence, I assume that there is nothing
further that can be done by you to keep Mr Aviles in prison
longer; there is no direct action you can take to make up for
your terrible mistake.

But there is one action you can take, to at least atone for it:
I believe that you should resign your position. You have failed
in your public trust, and should therefore relinquish your
public trust.

Dear Guardian of Philadelphia Parks:

I will make this short in the hope that you will take a moment to
read it.

As a native Philadelphian I have always regarded the park
system as defining a very special city. As a child, my family
would take Sunday strolls in Fairmount Park; as a Boy Scout, we
would take hikes along the Wissahickon; and where I would, later
as a parent, take my daughters for riding lessons; and where my
aging father would sit on a bench by the stream and adore his
beautiful grandchildren I live on a city block that ends at Morris
Park, where my daughters played when they were very young. And
now my grandchildren have the benefits of the parks.

I strongly urge you to provide the leadership required to
have and grow a healthy park system by supporting our slate of

Commission, I urge you to strongly consider the Coalition Slate

Pope, Doris A. Smith, or William A. Wilson, would be an excellent
choice for the existing vacancies.
As a member of the Wissahickon Restoration Volunteers, I have
seen first hand how the Wissahickon Park area has been allowed to
suffer from neglect and misuse. I have also seen the need for a
strong and visionary leadership to bring guidance and support for
the many grass roots organizations, such as the WRV, which are
trying to restore the Park to its former splendor.
Furthermore, it is equally vital to select a commission which
will find creative ways to manage the "confusing overlap of
mission between the Park Commission and the city's Recreation

one of whom could serve the whole well. Friends of philadelphia
parks also feel this is the best slection of people for the job,
too.
The parks are very important to me. I grew up in the city my
whole life, and as a child spent many summers playing in the
parks. I can't imagine living in a big city like Philadelphia
and not having the parks. As a late middle-age adult, I still
spend many evenings and Sunday afternoons strolling through the
parks. Forbidden Drive is such a treasure!! We need strong good
leadership tho maintain and preserve the lovely parks for future
generations. They are as important of an infrastructure to the
city as the big sky scrapers in center city. They need the same
attention!

Dear Guardian of Philadelphia's Parks:

The condition and quality of the park system - particularly our
'natural' park environments of Pennypack and Wissahickon - are
very important to me. They are, perhaps, the most compelling
reason for me to stay, and pay taxes, in Philadelphia.

It is evident that insufficient budgets, languishing stewardship
and etraordinary popularity have taken their toll on all our
parks over the past decade or so. We need to act quickly to
restore a balance, even if it means sacrificing some of our
accustomed freedoms of access and use.

Only a dedicated, educated board of conservators can successfully
manage the difficult task of healing these precious resources,
perhaps the best examples of urban parkland in the US.

Dear Guardian of Philadelphia Parks:

I am writing to express my support for the slate of seven
candidates for Fairmount Park Commission recommended by Friends
of Philadelphia Parks. These seven people,Ed Bronstein, Michael
DiBerardinis, Debra Wolf Goldstein, Joseph M. Manko, David P.
Pope, Doris A. Smith, and William A. Wilson, are highly
qualified. Together they represent the whole of our community and
each individual will bring excellent and needed skills to the
commission.

Fairmount Park is a treasure to be shared by the entire city. No
other resource is so widely utilized and enjoyed. I work at the
University of Pennsylvania with many students and fellows who
arrive in Philadelphia from other places around the world and the
many branches of the park continue to be the attraction that I
describe enthusiastically to everyone, regardless of the kind of
recreation they desire. Hiking trails along the Wissahickon
Gorge, festivals on Eakins Oval, fireworks at the art museum,
beautiful public art, historic mansions, roller blading, horse
riding...the list extends seemingly infinitely. The people on
this slate will serve with insight, sensitivity and dedication to
help us preserve this gem of a park system.

My husband and I choose to live in Philadelphia for many
reasons, but one of the most important is the city's magnificent
park system. Philadelphia's parks are one of its most valuable
resources, and they must be maintained and improved. Quality
parks attract and retain tax-paying citizens, and also better
the quality of life of those not fortunate enough to earn a
salary that merits taxation.

OUR PARKS. We should take great pride in the city parks and do
all we can to support them. The park system greatly enhances the
urban landscape. Too often the commisioners of the park system
have been hamstrung by the administration. That is why it is
important that there be visionary leadership for the future of
our parks and city.
