Dear Judge Fox,
I was hoping that a decision would have been made before
school started this past week. Jude is hysterical over my
house begging me to "FIX" this. Last Sunday he called his
Father and said he wanted to stay with me, I listened on the
call and David responded "The judge says you have to come with
me." Jude was refusing to get in my Aunt's car but we finally
got him to go to avoid being in contempt again. I called my
lawyer, the Arch Diocese lawyer, THe Master's division of Family
Court, Jude's Child Advocate, and DHS in an attempt to get some
help with our situation. I told JUde that I tried to help him
but that he always chickens out when it comes time to tell the
judge, his lawyer, DHS, the psychiatrist and that I have done
all I can do at this point. Jude called his child advocate
lastnight himself and left a message asking for help. What Jude
wants is when they do something special to go with them...when
we do to go with us...a few nights a week with me...Dave's off
nights with him and at least one weekend with his Father. I am
taking my foster son to Costa Rica DEc 26th-Jan 2nd...JUde does
NOT want to go..He wants Christmas Eve/Morning with me. He
wants Easter break with me to go to DisneyWorld. He wants half
Halloween night there...then come to our house. He wants to go
to our West Virginia TRip this month but he would miss school
two days. PLEASE HELP JUDE SOON! He started at Stelaa Maris
but isn't happy anyway so switching to Pope John Paul will be
fine if it is soon. We all need cl;osure but ESPECIALLY JUde
who is hurting. Next weekend he wants to go to Dorney Park with
his Dad Sunday....I SAID YES...I want Jude to be HAPPY...not a
prisoner. THey also take his cellphone from him 5pm each night
so he can not contact me or my family.
Sincerely a STILL concerned mother,

| Subject: | JUDE BICKEL SCHOOL |
Dear Sister,
We attended a custody hearing in July 2007. The judge
ordered two weeks vacation for Jude with David and then two
weeks vacation with me during the month of August. A Final
order was suppose to be given BEFORE school started. I called
the Masters division to try to get an answer and it just
says "Decision still pending" on the computer. Jude is an
absolute MESS. During the court hearing I found out that David
and Natalie were evicted from their home in February for not
paying their mortgage. They told Jude the roof collapsed and
they would KILL him if he told me where they moved to. I now
know they live at the corner of 12th and Oregon but plan on
moving again shortly. DHS will be back out to your school as
Natalie told me on Thursday morning that "Jude is not in school
dumbass." then hung up the phone. Jude told me that he is
attending school. During the past few months Jude has set
numerous fires and is now enrolled in the Fire Stopper program
at 240 Springarten street. Classes are Wed nights 6-7 pm.
I would like him to receive school counseling as he has
stated suicidal thoughts if he continues to have to live this
way. He cries to me every weekend and was prepared to switch
schools if the judge ever issued an order. I would like to be
involved in my son's educational process and request that ALL
school related materials be sent to my home. If my request is
not honored I plan on filing a civil suit. It is nothing
personal but I can not sit back and watch my son fail conduct
for another year, have poor grades, say suicidal comments and
generally get worse each day. I have contacted your lawyer
several times and I will be expecting weekly performance
updates, report cards on time, and notification of any
behavioral issues as soon as they occur. If my request is not
honored I will be forced into a position to take legal action as
we STILL have SHARED PHYSICAL custody...David only has sole
Legal which means he decides where Jude goes to school. There is
still the issue of Jude being in school unvaccinated for 5
months during the 2006-2007 school year. Overall I do think you
run a good school, I just don't feel its the very best match for
Jude at this time. I hope I can count on your cooperation.
Please send monthly calendars.

Honorable Judge Idee C. Fox,
You are probably not even allowed to read anything about the
case even though it is over. I just sit here in shock today
because I had no idea my son's Father lost his home, they moved,
he threatened to kill Jude if he told me. Jude still thinks
they left because the roof caved in and they are going back
there when it is fixed. Shock is all I can feel really. I feel
so sorry for Jude. Part of me wishes you could send him to some
great school far away so he could just be a kid again without
all this craziness. He was in school 5 months with no boosters
this year...I took Jude against the order saying David had legal
custody so he could be safe with Hep A booster, Menegititis,
Tetnis, Chicken Pox. David smokes in the car with Jude...I never
smoked (I wanted Kate to bring that up).
Things escalated after court Wednesday because they stole his
cellphone again and cut off communincation with our family,
Natalie text me she is snuggling all night with JUde (which I
find very creepy). David never had a psych exam and if mine
isn't glowing you wouldn't believe what his would have said. I
really am crying today for JUde, not myself. He has to live
with this mess for 6 years because no matter what decision you
make the constant fighting between families doesn't appear to be
lessening it just intensified after court. Kate will tell you
what I am asking for as far as custody and at this point I just
pray and pray and then pray some more.
I am getting out of the country to Costa Rica today and will
come back for my vacation time with Jude. He deserves fun
vacation with both families. I can't deal with the crazy texts
and the game playing. I would take another 5 years of David
beating me everyday if he would stop using my son for a sick
game of revenge. I know you will take all the testimony and
evidence into account and I do feel you will make the decision
that you believe is in JUde's best interest......I just hope
your guided by the hand of God in this one.
Sincerely a concerned mother,
Kristie Wisniewski

Dear Judge Fox,
Tomorrow the smoking issue will be raised in your courtroom.
Please take time to review the information sent and update
yourself on the current PA smoking custody laws. I am sure you

How YOU Can Fight Back If Your Spouse Smokes Around YOUR Child
Are you involved in a dispute over custody, and your spouse
smokes in the presence of your child and/or permits others to
do so?
Are you separated or divorced, and worried about the health of
your child when he or she is with the other parent who smokes in
the child's presence?
If so, you should know the following:
* In at least 18 states, courts have ruled that subjecting a
child to tobacco smoke is a factor which SHOULD be considered in
deciding custody.
* NO judge and no court has ever ruled that subjecting a child
to tobacco smoke should be IGNORED in deciding custody.
* In thousands of cases, courts have issued orders prohibiting
smoking in the presence of a child, especially in cars.
* In some cases the orders prohibit smoking in a home 24 (or
even 48) hours before the child arrives.
* In some cases, parents have lost custody or had visitation
reduced because they subjected a child to tobacco smoke.
* Existing court orders regarding custody, visitation, etc. can
often be modified if a child is being subjected to tobacco smoke.
* As the evidence of the harmful effects of tobacco smoke on
children increases, it should become easier to raise this vital
health issue.
* Even if no court in your state has yet ruled on this issue,
you should still raise it and use the legal precedent created by
these many decisions.
* Courts determine the legal custody and residential
arrangements in accordance with the "best interests of the
child." This includes medical health.
"The controversy over whether smokers damage the health of
people they live with has found its way into child custody
cases -- and that's bad news for smokers." Wall Street Journal
"Parents who smoke in front of their children may get burned in
child custody and visitation disputes." Lawyers Weekly
“This Court cannot comprehend [that] a parent, knowing that
their child suffers from asthma and severe upper respiratory
infection problems, with four (4) hospitalizations and twenty
(20) plus doctor visits in almost two (2) years, and being
warned of the danger of cigarette smoking as it affects the
child's asthma as well as the other well-publicized ... effects
of secondhand cigarette smoke, would continue to [smoke],
thereby directly contributing to the misery and suffering this
child has had to endure. To do this to a child is no less child
abuse than if you had deprived him of food or medical
treatment.” Actual appellate court decision. "The Trial Judge
found that the failure of the mother and grandmother to
discontinue smoking when recommended by the child's physician
was strong evidence of a lack of proper concern for the welfare
of the child. A belated cessation of smoking might evidence a
desire for the custody of the child rather than concern for the
welfare of the child."
Actual appellate court decision.
You can read about many recent developments related to smoking
and custody by typing "smoking custody" [without the " symbol]
into the search engine box on ASH's web site -- http://ash.org --
found on the upper left.
You can read a summary of some of the evidence about the effects
of smoking on a child by clicking here: ASH's Foster Care

You can also read some of the many news articles posted on ASH's
web page about the problems secondhand tobacco smoke can cause
in kids -- including asthma, increased risk of lung cancer, ear
infections, lower grades, Sudden Infant Death Syndrome [SIDS],
anti-social behavior, respiratory infections which can even lead
to deaths -- etc. by using the "Topic Index" on ASH's web site
under "Children and Tobacco" -- found on the upper right
In addition, as a special public service to help parents of
children who are being subjected to the many known dangers of
secondhand tobacco smoke, Action on Smoking and Health (ASH), a
39-year old legal-action charitable organization entirely
supported by tax-deductible contributions, has put together a
description of some of the leading judicial decisions in this
area of the law along with other important information of
special interest to parents in this situation.

Please don't hesitate. Drifting tobacco smoke already kills
more people that motor vehicle accidents, all crimes, AIDS,
illegal drugs, etc. In other words, people are statistically
more likely to die as a result of drifting tobacco smoke than by
a car, gun, or the AIDS virus. It has been estimated that
thousands of children are killed every year by drifting tobacco
smoke, and many suffer irreversible medical conditions.

Your Honor
I feel that it would be in Jude Bickel's best interest to have
him put in custody of his mother, Kristie Wisniewski. I am Jude's
grandfather and Kristie has always held Jude's well being as a
top priority. She has always tried to do the right things with
him and keep him on a straight path. She was always with him and
encouraged him to do his best in all his activities including
school and the Cub Scouts.
I feel that it would be a terrible injustice if he was not
allowed to be in the custody of his paternal mother.

Once upon a time there was a young tween that had been raised by
his mother to give more than receive, to value time over money,
and to put more thought into a person's total human worth rather
then their net worth. THe only problem was that all the tween's
friends had nice sneakers, expensive video games, and other
material and tempting possesions. The tween was sucked in by
the allure of all the shiny new things. One day the tween's
Father returned after years of hardly seeing his young son grow
up and felt tremendous guilt. He began buying the tween many of
the material possesions the tween so dearly coveted. Day after
day the tween received video games, sneakers, and clothes. The
tween was very happy at first :) Soon the tween wanted to spend
more and more time with his Father gathering more and more
possesions. The Father felt good and his guilt lessened. The
mother became very sad because she saw her son slipping away
into a materialistic self-centered world. She prayed a lot and
tried to continue to stress the important values in life. Even
though the tween seemed happy he started to get into more
fights, start fires, and generally have a poor attitude. THe
Father was perplexed so he took his tween on a vacation to the
shore and spent even more money. The thing the Father didn't
realize that it was HIS time with his son that would make the
big difference...quality time. The mother already knew this as
it had been her philosophy for many years. As the tween is
still growing it is uncertain how he will be as a teen....or
how he will be as an adult.....but the tween's fate can be
swayed very shortly in one direction or another.....THIS IS
WHERE YOU COME IN! We all make decisions everyday...some are as
simple as what to eat for dinner...but other more complex
decisions have reprocussions for generations to come.
Sometimes what we WANT in life is not equivalent to what we
really NEED in life. Maybe we can not always see what is best
for ourselves and that is why there are people like you in
positions of power to make the best decision when a young
wayward tween can not.

Dear Guardian of Philadelphia Parks:
I will make this short in the hope that you will take a moment to
read it.
As a native Philadelphian I have always regarded the park
system as defining a very special city. As a child, my family
would take Sunday strolls in Fairmount Park; as a Boy Scout, we
would take hikes along the Wissahickon; and where I would, later
as a parent, take my daughters for riding lessons; and where my
aging father would sit on a bench by the stream and adore his
beautiful grandchildren I live on a city block that ends at Morris
Park, where my daughters played when they were very young. And
now my grandchildren have the benefits of the parks.
I strongly urge you to provide the leadership required to
have and grow a healthy park system by supporting our slate of
Fairmount Park Commissioner candidates: ED BRONSTEIN, MICHAEL
DiBERARDINIS, DEBRA WOLF GOLDSTEIN, JOSEPH M MANKO, DAVID D. POPE,
DORIS A. SMITH, AND WILLIAM A. WILSON.

As a member of the Wissahickon Restoration Volunteers, I have
seen first hand how the Wissahickon Park area has been allowed to
suffer from neglect and misuse. I have also seen the need for a
strong and visionary leadership to bring guidance and support for
the many grass roots organizations, such as the WRV, which are
trying to restore the Park to its former splendor.
Furthermore, it is equally vital to select a commission which
will find creative ways to manage the "confusing overlap of
mission between the Park Commission and the city's Recreation
Department" (Phil. Inquirer 5/14/02)

The parks are very important to me. I grew up in the city my
whole life, and as a child spent many summers playing in the
parks. I can't imagine living in a big city like Philadelphia
and not having the parks. As a late middle-age adult, I still
spend many evenings and Sunday afternoons strolling through the
parks. Forbidden Drive is such a treasure!! We need strong good
leadership tho maintain and preserve the lovely parks for future
generations. They are as important of an infrastructure to the
city as the big sky scrapers in center city. They need the same
attention!
Sincerly, a concren citizen,

Dear Guardian of Philadelphia's Parks:
The condition and quality of the park system - particularly our
'natural' park environments of Pennypack and Wissahickon - are
very important to me. They are, perhaps, the most compelling
reason for me to stay, and pay taxes, in Philadelphia.
It is evident that insufficient budgets, languishing stewardship
and etraordinary popularity have taken their toll on all our
parks over the past decade or so. We need to act quickly to
restore a balance, even if it means sacrificing some of our
accustomed freedoms of access and use.
Only a dedicated, educated board of conservators can successfully
manage the difficult task of healing these precious resources,
perhaps the best examples of urban parkland in the US.
I believe the Coalition slate of candidates, specifically:
Michael DiBerardinis
Doris A. Smith
Ed Bronstein
David P. Pope
Debra Wolf Goldstein
William A. Wilson
Joseph M. Manko
have both the qualifications and the vision equal to this task.
Please show that you care by doing all you can to ensure that the
best possible appointments are made. It will be a decision that
accrues benefits across the generations.
Thank you.
