Judge Dembe,
My disappointment with the sentence of James Behan is beyond
words. Your tears suggest not an inkling of insight into the
pain experienced by victims of sexual abuse at he hands of the
Catholic Clergy. The dry season continues for those of us who
were brutally violated and desperate some small incarnation of
justice.

Dear Judge Dembe,

Thank you for such a common sence decision on the case of
the 'Philadelphia 11'. It's good to know that there are those
who still stand for freedom of speach, even though they may not
agree with that speach. Many preach tolerance until they don't
agree with what you say, then they have you arrested.

Thank you for standing up for those 11 people's right to
peaceably march!

Judge Dembe, thank you for dismissing charges against the 5
Christian demonstrators. It was the correct thing to do. But
what really distresses me even more is that they were arrested
in the first place. I am frightened by what America is evolving
into.

Your Honor;

I respect the freedom of speech and believe that everyone should
be able to express their views in a peaceful, respectful manner.

However, I felt compelled to write this note after hearing the
news that the protestors from last October's OutFest have been
acquitted for what I witnessed first hand, was nothing but pure
hatred towards the LGBT community. This day was to celebrate
our pride and what have struggled to accomplish as well as
encourage others that it's ok to be yourself. We will now
certainly remember this day in October thanks to Repent
America's disrespectful & antagonizing methods to spread their
so called "message".

We are well into the 21st century and should be making steps
forward, not backwards. The message will not only read in
today's headlines that Repent America has been dismissed for
it's actions , but it will also let others believe that it is OK
to form opinions about others based on their sexuality & that it
is acceptable to act on them.

Despite your ruling today, we will move on & continue to show
our pride. No group can take that away from us. If Repent
America should decides to voice its "opinions" next year we will
react as we did this year & hopefully justice will be served.

Dear Judge,

Thank you for your wise decision to drop charges on the 5
protesters from Repent America. Although I do not necessarily
agree with the way they went about with their protest, I do
agree with what you said to the news media about free speech
and our right to it. It is refreshing to see a Judge upholding

Thank you for dismissing all criminal charges against four Christians
who were arrested for evangelizing at an outdoor homosexual event.
It is important that all groups, in a public setting, be able to express their
freedom of speech as long as there is no kind of hindrance or violence
committed to any opposing parties involved, no matter what their
viewpoint or beliefs might be.
This was the right response to an outrageous abuse of power to silence
speech that some people didn't like.
Keep up the right and discerning work you are doing.

I hope that you dismiss the charges against the Christians on Feb
17, 2005 (because it would end their real risk of being
railroaded into jail, and conserve judicial resources, as this
case will be pursued up the entire appelate system if it goes
forward, until either the Pennsylvania Supreme court or the
United States Supreme court strikes it down) This is really not
the best test case even if you support the law.

the hard ship continues, after visiting my son (shaun)a
half dozen times a five hour round trip everytime, now shaun is
in the rock view facility (near state college) a sven and a half
to eight hour ride . the possibility of us visiting him is
getting slim to none now . oh yes by the way shaun has been in
the hospital for 4 days due to a overdose of medication given to
him by the facility , he went into seizures and luckly as he
fell to the floor his cell mate caught him , otherwise more
damage might have been done. it is a discrace that things like
this happen regularly in thia day and age . do you know what
country on earth has 5% of the population of the world and also
has more than 25% of all the imprisioned population of the world
ANSWER: THE UNITED STATES OF AMERICA ??????????

my wife and i finally got a chance to visit Shaun
at Camp Hill on sunday .when we first saw him we new there was
something wrong,he looks sadated,pale ,not normal looking at all.
when we were aloud to approach him i asked him what was wrong he
just said he was sleepy, but i knew there was something more.
afterspending some time with him he started talking about being
accosted in the yard and that he had a twitch(his neck and head
that he never ever had before)and his hands were violently
shaking and someone at the facility asked him what was wrong ,he
was taken to the doctor and is now taking 6 different medications
a day for depression ,etc.,etc., he didn't know the names any of
the drugs , i would imagine some were to help him with his
injuries incurred at THE DETENTION CENTER WHERE HE WAS HIT IN
THE HEAD KNOCKED TO THE GROUND , at that time he lost the
hearing in his one ear,he was having constant head ache's,his
jaw was in so much pain that he could not eat for 4 or 5 days
and while this is going on he is supposed to be in PROTECTIVE
CUSTODY ??????????????? I GUESS YOU THINK THAT HE WILL BE
REHABILITATED , and to this day he is still being taken
advantage of ONE OF THE GUARDS AT CAMP HILL IS TAUNTING HIM
TELLING HIM TO HIT HIM ,AND THE ANSWER TO THAT TAUNTING IS THAT
HE TOLD ME IS I AM NOT GOING TO HURT MY CASE B E C A U S E I
D I D N ' T D O A N Y T H I N G W R O N G . when will his
term in hell end , when will those girls feel remorse for what
they have done to another human being who is innocent. if you
could have seen vicky iazzy and how she acted in the hallway the
day of shauns trial you would be appauld.did you notice that
vicky didn't show up for the sentencing maybe she couldn't face
shaun and his family, the DA said she was on her way , she never
intended to come that day i asure you.

i will continue to write these
emails until my son is vindiacted of all charges , i will not
rest until he is set free and he , my wife, and i are compensated
for the angquish, loss of wages , being slandered etc. ,etc. .

We have received a letter from my son SHAUN someone
wrote it for him(he can not read or write as you should know ,
although the DA has other ideas saying at his sentencing that
shaun can hold a job then he could plan a rape , druging etc.,
but of course the DA'S do not do there home work ,why has shaun
collected SSI for 4 years if he could hold a job???)SHAUN HAS
ALREADY BEEN STABBED !!!!!!!! . This is an ongoing thing people
will just take advantage of SHAUN as VICKY has done and other so
called friends. his saga continues and until some one looks at
the facts -____TWO COMPLETELY DIFFERENT TESTIMONIES W H A T D O

T H I S M E A N EVIDENTLY NOTHING AT ALL . I do pray every
day for my son , for those girls(that they can live with there
lie),for you, and for the so called upholder of criminal justice
(the DA )i just hope that GOD will forgive all of you , further
i am going to come into some money soon and when i accquire a
real good lawyer i will take this city and its officers through
the court system and the law suites i will have instituted will

Inmate Jailed For 1982 Murder

PHILADELPHIA -- DNA evidence proves that a man on death row
since 1982 for rape and murder is innocent, a defense attorney
said Monday.

Nicholas James Yarris, 42, of Philadelphia, who is on death row
for the murder of Linda Craig, 32, of Boothwyn, was convicted
based on unreliable forensic evidence and witness testimony that
put him at the scene of the crime, attorney Christina Swans
said.

Recently completed testing shows that Yarris' DNA did not match
physical evidence left on the victim's clothing and under her
fingernails, said Swans, of the Federal Defender Association of
Philadelphia.


In the late 1980s, Yarris -- who has maintained his innocence --
became one of the first prisoners in Pennsylvania to demand DNA
testing. Tests done in 1992 proved inconclusive.

After Yarris exhausted his appeals in the state courts, federal
defenders took over the case and in 1997 demanded new tests,
which were completed last week, Swans said. Each piece of
evidence, kept by the Delaware County District Attorneys Office,
was retested and each piece excluded Yarris, Swans said.



The Delaware County District Attorney's Office did not

so know Shaun has gone from state road to Graterford,to Camp
Hill ( affectionaly known as CAMP HELL), and in about six weeks
he will go to another facility. do you look at the news,
everyday there are people released from prison because they were
innocent, just today MR. YARRIS in graterford prison may be
released or be able to have another trial (maybe a fair one),
all of this is because of DNA. gee where is the DNA in shaun's
case????if my son isn't crazy now he will be before he gets out
of the prison system in this state . there is not a person that
gives a ...... about shaun in the police, da's etc etc, the
DA'S office is just a engine to raise money for the city and the
state.the evilness of these people is atrocious .that is good
business , get those people in the facilities on state road ,
notify the state , now the city will get 110.00 a day per inmate
from the state , that is 770.00 a week per person and if you
have 1000 prisoners that is 770,000.00 a week , and in 10 weeks
thats over 7 million dollars . this is what makes the city run ,
because THE BUSINESS IN THIS CITY IS THE CITY GOVERMENT.and in
turn the state receives funds from the federal goverment for
inmates.THIS STATE , THIS CITY, THIS COUNTRY, SHOULD SPEND MONEY
ON NEW SCHOOL'S AND EDUCATION AND NOT ON BUILDING PRISON'S , YOU
WOULDN'T NEED ALL THE PRISON'S WE HAVE. ALL STATISTICS SHOW THAT
INMATES ARE TO A LARGE DEGREE EITHER DROP OUTS , HAVING
PROBLEM'S IN SCHOOL WITH NO HELP, ETC, ETC, and you know it is
true

prison's in this state especialy, i don't think u have . i had
to turn off the computer i got so upset u would not beleive the
treatment the inmates and there families receive at these

to Shaun when he gets out of prison my wife and may be dead, how
will he survive , then he will have to become a criminal just to

my son shaun has come from a loving family , shaun
has 4 brother,s 2 older and 2 younger and also a younger sister.
his parent's have been together for 27 years , they were married
in 1976 and are still devoted to each other and to there
children. it hasn't been always easy raising 6 children but i
would not give up those years for anything, over the years we
have so many good times all together.i don't want to say
anything derogitory about a court appointed lawyer but they are
under so much pressure to push through on there cases because of
there work load and ther lack of assistance from subordinates .i
know that if i had the funds for a paid lawyer and for
investigators etc., that the real truth would have come out at
his trial. my wife and i cry every day over shaun's problem's .
we visit shaun every week , twice a week in the last 2 months
shaun has been sucker punched in the head and face , he was
unable to hear out of his right ear for almost a week , he could
not eat for three days because his jaw was hurting him to much ,
and he is supposed to be in protective custody ( those words
don't mean a thing) . as i told you in a past email shaun has
never hurt anyone in his life to the point that he doesn't even
defend himself, those girls came to my home more than once ,
they came to my home on the night in question after 12am friday
march , they were staying out for the night , and they left my
home as requested by shaun and his brother and proceeded back to
pory richmond to be with vickys boy freind who at the time was
23 years old and when they reralized in the morning that they
didn't have enough money to get home by pulic transportation
they came back to stupid shaun's house who would help anybody .
shaun didn't have any money so he called his friend to give some
money to the girl's to get home ( shaun wasn't due to get his
ssi check till monday the 30th of march) i have tied to tell
shaun not to let people take advantage of him but that is the he
is , an example is shaun sold a brand new 27 inch 400.00
television that he only had for a month so his friend could his
car towed and fixed and guess what he never saw that kid again
and shaun was left in a whole again , i can give many many
examples but there is only so much time and only so much i can
stand talking about his problem's of being to good for his own

i would like you to read the notes of testimony from Shaun's
hearing in july of 2002. i don't know if it is availble to you
but it took place in courtroom B the presiding judge was a judge
bruno an older man , the notes from this hearing are so
different form what the girl's stated at his trial in march of
2003?? those girls lied about everything , they said they came
to my house at 8:30 one girl said , and the other said 9:30 . ok
i'll give them an hour leeway , but my wife and i do not go to
bed before 11pm or 12am on a regular basis, i cannot remember me
going to bed before the finish of the 11oclock news or watching
the tonight show ,letterman etc.in the last 30 years . i did not
see those girls they came to my house after midnight and as my
son's stated to MICHAEL APPLEBAUM

i know that chaplin's and other official's are not alloewed to
go to court or write to the respective judge's about an inmate,
but WOULD YOU PLEASE CALL his chaplin PHYLIS TAYLOR , SHE HAS
BEEN TLAKING AND WORKING WITH shaun for the better part of a
year now and she may have some insight to how shuan really is

judge Pamela Dembe , i am writing to u in
desparation about my son Shaun Moore . there are so many facts
that were not brought to light in my son's trial, if i had the
funds to keep Michael Applebaum as Shauns lawyer the out come of
his legal procedings at his trial would have turned out
completely different . just recently a freind of shauns called
my home and told me that he been in the company of his cousin
and her girlfreind as there conversation went on this girl named
Amber said to my son's freind u better not mess with me or i'll
frame u like vicky (VICTORIA IAZZY) framed SHAUN . that vicky is
a bad influence on the other girl Rachel Greenwald in fact on
the day of Shaun's trial she was proding Rachel and the
conversation led to VICKY(victoria) saying well i am leaving and
Rachels response was you can't leave yet , and vicky answered
just watch me and looked at me and said i can do anything i want
and i am leaving ,laughing while she was walking down the hall
if she really was violated in any way why would she not stay to
see what the outcome was ?? this Victoria is a real nasty excuse
for a young woman in fact her ex boyfreind Joseph Force who had
been introduced to drugs by vicky had deid of an overdose of
drugs last fall . vicky had been trying to get Shaun to get Joe
Force to go back to vicky but Shaun could'nt find a way to get
in contact with him because he had run away from home several
times and supposedly was living with an aunt in kensington .
Vicky was mad a Shaun for not complying with her wishes and
called our home several times telling my wife that shaun owed
her money and that she was going to get it one way or another my
daughter also answered phone calls to the same senario of
getting money from shaun . if i had the money for a paid lawyer
and investigators etc., etc., i know shaun would have been
exonerated of his charges. you see thats the way it is in our
system if you have money (ex. Druce , eagles wife who run people
over with there cars) get away with MURDER but if poor you are
out of luck and you just go to prison to creat funds for the
CITY and the STATE . nothing i have written to you is false ,
people who are innocent are imprisoned every day . please
consider only a small portion of what i can tell you about my
son and the case . sincerely
