judge gordon,
i know you won't read this email but i feel as though in
writing this it will be a matter of public record through this
website.does any of this sound familiar , discription of youth
by so called witness; 5'8" freckle faced irish american looking
boy (my son Michael Moore 5'2" 98 lbs and not a freckle on his
body - by the way the height and weight is a matter of record
taken at the day of his false incarseration at the youth study
center). everyday in this country there are falsly convicted
citizens (? ) found not guilty and admonished of there charges
the following is just one example .
grant a pardon to a man who served 27 years in prison before his
murder conviction was overturned almost two years ago.
Ehrlich said Friday that a lengthy review of the records of the
trial convinced him that Michael Austin "served 27 years for a
crime he did not commit." Austin had been convicted of the 1974
killing of a convenience store security guard.
"I talked to him today. I apologized to him, although words were
very difficult to come by," the governor said.
Ehrlich also said he thinks Austin should get some compensation
from the state for the years he spent in prison, but said he
doesn't have a figure in mind.
"What's a year worth? What's a month worth? What's 27 years
worth?" the governor asked.
The "full and complete" pardon given to Austin, Baltimore
resident, will allow him to seek compensation from the state.
The decision on whether to give him money and how much will be
made by the Board of Public Works, which includes the governor,
Comptroller William Donald Schaefer and Treasurer Nancy Kopp.
Larry Nathans, the lawyer who represents Austin, said he and
Austin talked to Ehrlich Friday morning.

"He felt very good about it. He was personally touched that the
governor had spent so much time looking at the matter and that
the governor personally called him," Nathans said.
Austin was convicted of killing Roy Kellam at an East Baltimore
store.
His arrest was based on a mug-shot identification by a clerk at
the market who told detectives at the scene that the shooter was
a light-skinned black man, about 5-foot-8. Austin is 6-foot-5
and dark-skinned.
The only physical evidence against Austin was a wallet card that
had scribbled on it the name of an alleged accomplice, a man who
was later freed by police after they said they had the wrong man.
Austin's attorney failed to subpoena witnesses or a timecard
from Austin's employer, which would have shown that he worked
the day of the killing.
Judge John Carroll Byrnes, who overturned the conviction, said
the defense attorney, who is now dead, was incompetent, the
prosecution had committed errors and the trial judge have jurors
faulty instructions.

i am the father of six children 5 boys and 1
girl,and michael is my youngest. i know that when a child does
something wrong and i whole heartedly agree on punishmemt for
what they have done wrong. but first they have to break a rule
or some other infraction, M I C H A E L M O O R E IS INNOCENT,

makes no sense when you look at the FACTS , not trumped up
fabricated statements that were made at michael's ? trial. look
at what was said , look at the notes of testimony, look at the
pictures of my son and the pictures of the youth that was
arrested( caught in the act by police)the day befor michael's
trial. you didn't see them , i sent them to you more than once
and the lawyer also gave you copies , if you looked at them than
there should be no question in your mind , but then i can't
understand your thoughts on the case (IF THIS IS NOT JUDGE

the weather condition's of that day and i quote ( da)" could you
tell us what the weather was like on march the 21st the day in
question" witness? answers " yes it was sunny and clear " i have
sent you weather reports from THE NATIONAL WEATHER SERVICE &
from INTELLICAST .COM , both of the reports state that it was a
rainy , drizzle , & fog that day ?????? i can't beleive that you
could actually not see what is going on here , the dirty rotten
lies, farication's & falicies that the da's office and the
police dept had set forth on my son's made up case . doesn't the
police write down what an arressted person is wearing when they
first saw the person , and what they were wearing when he was
taken to the police station after being dragged down the steps
and told that the woman that he was supposed to have robed was
dying and was in critical condition and she dies that michael
would go to prison for LIFE and then was asked if he was
RETARTED because he simply asked to go to the bathroom ????????

I have been informed by the father of Michael Moore, an employee
of mine, that Michael has a hearing set for the 30th of this
month.
I have spoken at length with Mr. Moore about the legal matter in
which Michael has been involved. I have been presented with the
evidence in this case and am extremely distressed to hear that
Michael's matter apparently has been mishandled.
Mr. Moore informs me that there is evidence that could prove
that his son is not guilty of any crime, yet you have refused to
hear it. I would hope that in the interest of your judicial
integrity you would review all the facts concerning this case.
Michael had a job ready for him this summer. He's been employed
with me for a couple of years now. Knowing his character, I'm
sure that there is something that you're overlooking. With that
in mind, please remember your responsibility to the people of
Philadelphia and to all matters pending in your courtroom.

Judge Gordon,
here is an update on my son Michael P. Moore. since
he left the hospital on tuesday the 15th of july he has had
chest pains , he was taken to the hospital emergency (st.chris's)
and was sent back to the NET, the dortor said they couldn't find
anything wrong with him and perscribed 400 mgs of motrin for his
pain. he still has the pains today , it is july 21st(monday)and
i finally got intouch with doctor Soriano(@ st. chris's)i had
left a voice mail for his nurse practitioner on friday the 18th
of july but he never answered or returned my call. when i spoke
to Dr. Soriano and told him that michael had been at the
hospital emergency and that he was perscribed motrin he was
extremely concerned and told me to call the NET and tell them
not to give michael the motrin it would only make him have more
pains. the doctor wants to see michael asap and to call the NET
back and have them make an appointment and bring all the
medicines that he is taking at this time . michael has an
appointment on wednesday the 23rd of july at 1100am . my wife
and i visit michael every day that is allowed and when we visted
him yesterday he hardly spoke , for the 2 hours we were there he
only spoke the last 15 minutes of our visit?? this is the first
time this has happened, i will probably have to get the NET to
take michael to see a psyhcologist because he is having alot of
trouble dealing with the plate that he has been served . he is
the type of person who takes everything to heart and his
condition will never improve under his circumstances. it is bad
enough that he was falsely accused , treated like an animal by
the 15th district police station , dragged down steps like a
sack of potatoes, officers asking him if he RETARDED because he
asked to go to the bathroom , telling a little kid and he is a
very young 16 year old not like you may think , and know this
illness , these things can only adversely affect his pubesent
years .

I forgot one of michael's biggest disappointment's
in his life that he was not accepted into SWENSON SKILL CENTER
(high school) where michael wanted to study culinary arts (he
love's to cook)and he was very excited about his summer job he
lined up at the VOGT recreation center on KNORR st in the
northeast, the supervisor who is a teacher ata local catholic
school told michael that he would save him the job because he
thinks so much of him. by the way this teacher has visted
michael in the hospital etc. etc

i am writing you out of desperation , my son
michael will never get well he has a chronic desease and stress
makes it worse . you don't know my son ,you don't know what kind

citizen's.i don't understand ,,,, the witness's didn't even look
at michael ,they half turned there heads in the courtroom . look
at the note's of testimomy , the discription of the youth is A
IRISH AMERICAN LOKKING FRECKLE FACED BOY , FIVE FOOT FIVE TO
5FOOT EIGHT , WEARING LIGHT CLOTHING THE WITNESS'S SAID IT WAS
A CLEAR AND SUNNY DAY?????? know the fact's when michael was
stoped by a police officer on rowland ave. he was wearing the
same BLACK HOODED SWEATSHIRT(not light clothing ?)he is ( if you
want to check the youth study center weighted and measured him )
FIVE FOOT TWO INCH'ES AND WEIGHTS 98LB'S . michael has probably
2 or three freckle's on his entire body???when i picked him up
from the police station after being dragged down his freinds
step's and put into the police car , processed at the station ,
was told that the woman was in critcal condition and she might
dieand he would go to prison for the rest oif his life , nice
thing to say to a kid . when he asked to go to the bathroom at
the station the detective asked him if he was retarted???? WHY?
yes when i picked him up from the police station after 10 hour's
guess what he was wearing the same BLACK sweatshirt that he was
wearing in the morning when he left to go to school. to continue
above i wrote exactly what the witness said what the weather was
like that day , WRONG march 21st was a miserable,
dreary ,cloudy ,wet , raining off and on all day. if those ?
witness's can't remember what the weather was like and waht the
youth looked like (see there discription's vs what michael
looks like)then how in GOD's name can they positivley identify
him as one of the youth's ( THERE WAS TWO ??).i will te;\ll you
how they are only going by what the police are telling them and
probably in there minds they may beleive ( although they did
have avery good time laughing about the whale thing in the
courtroom waiting room ?? i think the seriousness of this is
obliviuos to them . do they have children ? no i think not .i
was in that courtroom almost all day and every child that had a
paid lawyer went home and most of them were found not guilty??
and while i was there every child that had a piblic defender was
locked up and found gulity ? michael has never been in trouble ,
grades kindergarten through 8th grade and his first year ib
highschool he had PERFECT ATTENDANCE ALMOST FOR THE ENTIRE
YEAR , EVERY YEAR ?? . i gave a long disortation to shirley
wasington who works for the first judicial district( i am not
sure what this is) i don't know if she wrote down all of the
problem's we have been having with the school but it is a
lengthy one . the school does'nt have a clue what is going on .
michael went 4 month's in the 2000/2001 school year without
having a math class I DISCOVERED IT AND BROUGTH IT TO HIS
ENGLISH TEACHER'S ATTENTION, and she followed up on it for us
because whaen you talk to one of the women that work in the main
office you nowhere.the school also gave him a WEB DESIGN class ,
i spoke to his teacher and after telling him of michael's reding
problem he told me there was know way he could do the work in
his class ( he stayed in that class for the whole year cluless ??
in his 2002/2003 school year other problem's occured , in august
you receive a letter from the school it tell's you when to
report for the first day of school etc.,etc, and it also tell's
you the book number , the book number identifies your advisory
room (home room ), well the letter stated his book number was
304, ok well michael went to school for 24 day's going to the
wrong advisory , he was marked absent for 24 days.only until one
of his teacher's called us on the telephone and wanted to know
why michael was attending her class but was never in her
advisory ( she had him for both) , after a long discussion at
the school with a half a dozen people we were told that
michael's real book number was 302 ?? the cshool blamed michael
and i until i showed them the letter and envelpoe with book
number 304 on it they didn't know what to say that's there usual
answer over there i have been over to that school so many times
because of there lack of professtionalism it is rediculous. then
michael's name badge didn't work every morning when he went to
scan in it wouldn't work and he wolud have to show his roster to
get into school this went on for more than a month , i had to of
course go to the school again to get it straightened out , and
was tod he was off the roll and was marked absent for a long
period of time and that he should have come to the office a long
time ago he didn't tell anyone it did 'ntoccur to him there
would be a big poroblem with that ? in november i went to
lincoln high school to try to rectify some other problem's and i
asked to transfer him to another school at the main office ,
there are 6 women working in the office and not one of them
could find or knew where such form's where , the one woman that
i had dealings with many times before was giving me a hard
time , nothing happened i left. in december michael stared to
get sick but didn't say anything to us ,loose bowles etc. . he
was now ( in january ) a lot of problem with his stomach . i
called the doctor's and the doctor sugested imodium etc. , it
helped for a while ( this is the end of january), many of his
teacher's wouldn't let him go to the bathroom , now he was
cutting classes and going home early because he was having
accident's in his pant's in the begining of march or end of
febuary we got a doctor's appointment because he told us he
wasn't feeling well, he was embaressed to tell the nurse on day
ai had to pick him up from school i told her on the phone what
the problem was , one day he had a low temperature of 96o i took
him to the doctor's 3 more times stool cultures were taken and
the found nothing they were saying he had a virus , but of
course you now know as i do that it was the onset of ulceractive
colitis he came home from school running in the house tajing his
clothes off in the basement and going to the shower at least a
half a dozen times this occured finally we were able to get an
appointment at the NELSON PAVILLION adjacent to st chris's hosp.
and doctor SORIANO was pretty sure he had either chron's desease
or colitis but a colonoscopy would have to be done and then his
trial came up and you should know the rest . if you would like

(WWW.ccfa.org ). michael comes from a loving family he has 4
brother's and a sister ,THERE IS NO WAY THAT MICHAEL COMMITTED
SUCH A CRIME , where is the other youth ??????. the NET and MS
HOgan has his medical records please look at and consider all
that i have written . crohn's and colitis never goes away he
will live with this forever.

Dear Guardian of Philadelphia Parks:
I will make this short in the hope that you will take a moment to
read it.
As a native Philadelphian I have always regarded the park
system as defining a very special city. As a child, my family
would take Sunday strolls in Fairmount Park; as a Boy Scout, we
would take hikes along the Wissahickon; and where I would, later
as a parent, take my daughters for riding lessons; and where my
aging father would sit on a bench by the stream and adore his
beautiful grandchildren I live on a city block that ends at Morris
Park, where my daughters played when they were very young. And
now my grandchildren have the benefits of the parks.
I strongly urge you to provide the leadership required to
have and grow a healthy park system by supporting our slate of

Dear Guardian of Philadelphia Parks:
In your selection of new members to the Fairmount Park
Commission, I urge you to strongly consider the Coalition Slate
of Candidates. Any one of the coalition, Ed Bronstein, Michael
DeBerardinis, Debra Wolf Goldstein, Joseph M. Manko, David P.
Pope, Doris A. Smith, or William A. Wilson, would be an excellent
choice for the existing vacancies.
As a member of the Wissahickon Restoration Volunteers, I have
seen first hand how the Wissahickon Park area has been allowed to
suffer from neglect and misuse. I have also seen the need for a
strong and visionary leadership to bring guidance and support for
the many grass roots organizations, such as the WRV, which are
trying to restore the Park to its former splendor.
Furthermore, it is equally vital to select a commission which
will find creative ways to manage the "confusing overlap of
mission between the Park Commission and the city's Recreation

Dear Guardian of Philadelphia Parks:
I endorse the slate coalition of Ed Bronstein, Michael Di
Berardinis, Debra Wolf Goldstein, Joseph Manko, David Pope,
Doris Smith and William Wilson. They represent a broad
constituency of people with varing backgrounds and skills, any
one of whom could serve the whole well. Friends of philadelphia
parks also feel this is the best slection of people for the job,
too.
The parks are very important to me. I grew up in the city my
whole life, and as a child spent many summers playing in the
parks. I can't imagine living in a big city like Philadelphia
and not having the parks. As a late middle-age adult, I still
spend many evenings and Sunday afternoons strolling through the
parks. Forbidden Drive is such a treasure!! We need strong good
leadership tho maintain and preserve the lovely parks for future
generations. They are as important of an infrastructure to the
city as the big sky scrapers in center city. They need the same
attention!

Dear Guardian of Philadelphia's Parks:
The condition and quality of the park system - particularly our
'natural' park environments of Pennypack and Wissahickon - are
very important to me. They are, perhaps, the most compelling
reason for me to stay, and pay taxes, in Philadelphia.
It is evident that insufficient budgets, languishing stewardship
and etraordinary popularity have taken their toll on all our
parks over the past decade or so. We need to act quickly to
restore a balance, even if it means sacrificing some of our
accustomed freedoms of access and use.
Only a dedicated, educated board of conservators can successfully
manage the difficult task of healing these precious resources,
perhaps the best examples of urban parkland in the US.
I believe the Coalition slate of candidates, specifically:
Michael DiBerardinis
Doris A. Smith
Ed Bronstein
David P. Pope
Debra Wolf Goldstein
William A. Wilson
Joseph M. Manko
have both the qualifications and the vision equal to this task.
Please show that you care by doing all you can to ensure that the
