Subject:   Civil Rights Violations

On 2/05/96 I was convicted of criminal conspiracy and sentenced
to 5 to 10 years. According to the prison forms (DC-23B) and
both (DC-16D ) I was convicted of criminal conspiracy to commit
aggravated assault as to Eddie Polec. I appealed my conviction
to a panel of the Pennsylvania Superior Court. My sentence
was vacated and remanded for clarification. The Commonwealth
blocked the first court order by petitioning for en banc
reargument, became the verdict winner which changed the
criminal conspiracy to commit aggravated assault to criminal
conspiracy to commit third degree murder (see page 1.
Commonwealth of Pennsylvania vs. Carlo Johnson).

I contacted the State Police Central Repository in Harrisburg
to obtain my official conviction record. The (SP4-127B)
document I received simply states criminal conspiracy. I hired
an attorney to find out what I was convicted of, since none the
paperwork matched. My attorney received the official court
records which matches the (SP4-127B) from the State Police
Central Repository. Criminal conspiracy to commit aggravated
assault as to Eddie Polec and criminal conspiracy to commit
third degree murder does not exist on any official court
document. The verdict sheet does not say criminal conspiracy
to commit aggravated assault as to Eddie Polec nor criminal
conspiracy to commit third degree murder .

Pa.C.S.A. 903. Conspiracy states: For purposes of criminal
conspiracy, the overt act need not be committed by the
defendant; it need only be committed by co-conspirator.

If this is true, how was I found guilty of aggravated assault
conspiracy as to Eddie Polec?

No-one was charged with aggravated assault or aggravated
assault conspiracy as to Eddie Polec.

According to the law, in a Jury trial the jury decides what you
are guilty of. In this case the trial Judge decided I was
guilty of aggravated assault conspiracy, the full Superior
Court of Pennsylvania decided I was guilty of third degree
murder and the official court documents do not say either.

How can anyone defend themself in a court of law if this
allowed to happen?

How is the court allowed to ignore the warrant and the verdict
sheet?

Is there any legal recourse for me to fix this?
